Generally a contract is signed for a certain period. A change in basic pay is being recommended by Pay Commissions. These pay commissions are recommending better pay scales after a certain period for only those employees who are governed by CCS (CCA) Rules. The Pay Commission does not cover the contract employees. Yet, these contract employees have filed many cases in Hon’ble CAT and High Court and won too. But the Hon’ble courts see another angle. They accept the logic of same work same pay.
According to our views... no arrears can be granted on the terms of contract but court can grant some relief on the basis of same work same pay.
